Bond Representation

“Bond representation” typically refers to legal representation provided to an individual who is detained by immigration authorities and seeks to be released from detention on bond or other conditions while their immigration case is pending. In the context of immigration detention, a bond is a payment that the detainee or their representative can make to secure their release from detention while their immigration case is being resolved.

Bond Representation requires a personalized service which includes direct interaction with a detainee’s family and community to gather necessary evidence. Some of our work includes preparing sworn statements, contacting employers and friends for letters of support, and preparing witnesses.

This is an overview of the bond process:

  1. Detention: When an individual is apprehended by immigration authorities, they may be placed in detention if they are deemed to be a flight risk or a potential threat to public safety. Detention facilities can be operated by various entities, including Immigration and Customs Enforcement (ICE) in the United States.
  2. Request for Bond: If a detained individual believes they are eligible for release, they or their legal representative can request a bond hearing before an immigration judge. The purpose of the bond hearing is to determine whether the individual should be released from detention while their immigration case is ongoing. The judge considers factors such as the person’s ties to the community, flight risk, and potential danger to the public.
  3. Bond Amount: If the immigration judge determines that the individual is eligible for bond, they will set a bond amount. The bond is a sum of money that the detainee or their representative must pay to secure their release from detention. The bond’s purpose is to provide an incentive for the individual to appear at future immigration court hearings.
  4. Bond Representation: Bond representation refers to the legal assistance provided to the detained individual during the bond hearing process. An attorney or legal representative can help the detainee present arguments and evidence that support their eligibility for bond. The representative can present information about the person’s ties to the community, family, employment, and other factors that demonstrate their intention to comply with immigration court proceedings.
  5. Bond Hearing: The bond hearing is a formal legal proceeding during which the immigration judge reviews the detainee’s circumstances and determines whether they should be released on bond. The legal representative presents arguments on behalf of the detainee and advocates for their release under reasonable conditions.
  6. Bond Payment: If the immigration judge grants bond, the detainee or their representative must pay the specified bond amount to the relevant authorities. This payment serves as a guarantee that the individual will attend all required court hearings and comply with any conditions set by the judge.

Bond representation is a crucial aspect of the immigration process for detained individuals. Having legal representation during the bond hearing helps detainees present a stronger case for release and ensures that their rights are protected throughout the process. If the bond is granted and paid, the individual can be released from detention while their immigration case continues. It is an opportunity to present a case before the judge without being detained.
